While Tennessee’s officials aren’t too eager to legalize THC and marijuana, they have been more than happy to frequently adjust their CBD laws to help manufacturers and CBD users.
The state’s officials have actively worked towards fully legalizing CBD since 2014, and for the most part, their CBD laws are lenient and easy to follow.
However, you still need to know what you can and can’t do in Tennessee, or you can find yourself in a bit of hot water.
If you’re a little confused about Tennessee’s CBD laws, you can learn more about them over the following sections.
First, to help you understand how frequently Tennessee’s lawmakers adjust their CBD laws, we’ll look at the history of Tennessee’s hemp legislation.
The first hemp law passed in 2014. It was a result of the 2014 Farm Bill. It was a fairly simple law, and it just decriminalized the growth of hemp plants. It didn’t legalize hemp farming, but it ensured that people wouldn’t spend years in jail for growing a couple of hemp plants.
In 2016, Senate Bill 2125 was passed, and it decriminalized the possession of small amounts of cannabis. That includes hemp and marijuana. It also legalized medical marijuana for patients who suffer from terminal illnesses, and it legalized medicinal CBD for epilepsy patients that are children. To be clear, recreational marijuana is still illegal in Tennessee. You just won’t be punished very harshly unless you possess a lot of it.
Finally, lawmakers legalized the recreational sale and use of CBD products in the earlier months of 2019, and they set the groundwork for them to start growing industrial hemp products. Now, the state has several hemp crops that are used for everything from hemp rope to CBD oil.
Tennessee’s CBD regulations are pretty fleshed out, too. The state’s officials haven’t been as slow as the officials in other states. You can purchase hemp-derived products that have less than .6 percent THC in them if you’re buying them for recreational use, and you can use CBD products that have .9 percent THC if you’re given a prescription by a licensed doctor.
However, the state’s health department has not legalized the sale of food products. So, restaurants still can’t make CBD food items for you, and you won’t be able to purchase any prepackaged items, either. Luckily, Tennessee’s lawmakers created a loophole that allows you to enjoy food items despite that ban.
You are free to order CBD items online, and they can be shipped directly to your home without any issues. You can order CBD desserts or candies, and Tennessee’s law enforcement officers will leave you alone. However, you cannot order CBD products that exceed the THC limit that Tennessee’s officials have agreed on. That’s not a horrible restriction, though. The state already allows you to have more THC in your CBD than most other states.
You do need to be careful when you order CBD products, though. Stores in Tennessee are frequently checked to ensure that they comply with the state’s CBD laws, but online retailers can do whatever they want for the most part. Make sure to heavily research any product that you purchase online, and research the company that sells it, too. A lot of shady retailers are using the internet to distribute fake or low-quality CBD products.
Hemp growers are the ones that face the most regulations. However, the regulations are more lenient than what you’ll see in pretty much every other state. If you want to grow hemp, you must apply for a license from the Tennessee Department of Agriculture.
Unlike other states, it’s fairly inexpensive to get a license in Tennessee, and you only need to get one if you want to actually grow hemp. Last year, you had to have one if you handled raw hemp in any way. So, manufacturers and people who sold raw hemp had to go through the licensing process. Now, they don’t have to do all of that. The downside to this law being passed is that you’ll have to reapply for a license by June of 2020 if you still want to legally grow hemp. Since the entire licensing process was redesigned, your current license is outdated.
One thing that you must look out for is the concentration of THC in your CBD products. While the state is lenient, it doesn’t mess around with marijuana products. If you have a lot of CBD products that exceed the generous THC limit that Tennessee’s lawmakers have in place, you can face a federal charge and a $2500 fine.
As usual, the federal government has essentially thrown a wrench into the gears of the CBD industry. It’s true that the CBD industry wouldn’t have gotten off the ground without the federal government creating the framework for it, but the federal government has mostly held it back since then.
Confusing laws and the FDA’s absurd guidelines have made it difficult for states to create laws that are consistent across the country, and it’s difficult to tell if CBD is even legal in its most basic forms in some states.
When it comes to the federal government’s laws, a lot of people get confused by the fact that they only legalize the sale of hemp-derived products. They don’t mention CBD. It’s true that CBD is a hemp-derived product, but it’s also considered a drug since the FDA added it to its list of approved epilepsy medicines. That means that it’s the FDA’s right to regulate CBD, and it doesn’t matter that the federal government legalized all hemp-derived products.
Since the FDA regulates it, the FDA claims that CBD is illegal unless individual products are submitted to the FDA for testing and approval. That’s extremely expensive for companies to do, and most small companies don’t have the funds necessary to have their products approved by the FDA. It’s also completely unnecessary since we already know that CBD doesn’t have any negative side-effects besides headaches and nausea.
Luckily, the FDA only has the right to regulate food items and items that make therapeutic claims. So, if a manufacturer leaves therapeutic claims off their packages, and they don’t sell food items, their products are legal regardless of what the FDA says. Also, a lot of states are choosing to allow those products to be sold whether the FDA likes it or not.
How To Use It
You can find CBD in so many different forms that it’s impossible to list every product that is available. It’s such a flexible product that manufacturers can do just about anything with it.
However, we can easily talk about some of the items that are popular among other CBD users.
CannaDip is a new brand that specializes in making cannabis-based dip.
CannaDip does have a THC variant of their cannabis-based dip, but we won’t talk about that a lot here. You can’t use it in Tennessee.
The CBD variant is what we want to talk about. CBD CannaDip comes in a few different flavors, and more flavors are in development. Each can of CannaDip comes with about a dozen pouches of hemp-based dip that you place between your gums and your lower lip. Over time, CBD is released into your gums, and you feel a relaxing sensation.
Unlike tobacco-based dip, you don’t have to spit when you use CannaDip. It doesn’t cause you to have horrible stomach aches, and it doesn’t hurt your throat. You’ll also be happy to know that it doesn’t cause your gums to shrivel up as much as tobacco-based dip does.
CannaDip is more expensive than a can of Copenhagen or Grizzly, but it’s still affordable.
CBD Gummy Candy
First, you should know that you won’t be able to buy these products from your local gas station. You’ll have to order them online. However, they’re a fun way to enjoy CBD.
Instead of messing around with oils, sprays, creams, or tobacco alternatives, you can simply eat a gummy bear or two. These usually come in jars like gummy vitamins do, but they’re packed with CBD, and they’re just as delicious as normal gummy bears.
However, they’re kind of expensive. You’re not going to purchase a whole jar of these for a couple of bucks. You’ll have to spend at least $20 to get a product that is worth using.
CBD Pet Snacks
If you’ve looked at the other CBD articles we’ve written, you know that there are plenty of pet products that your pet can use. However, sprays and creams can be hard to entice your dog or cat with. That’s why CBD pet snacks exist.
Instead of spraying oils into your pet’s mouth, or mixing things into their food, you can simply give them a treat. They’ll appreciate the snack, and they’ll feel better once the CBD takes effect.
Tennessee has frequently changed their hemp laws over the last decade, and those laws are expected to continue to change until Tennessee’s lawmakers feel that CBD users and manufacturers have a fair amount of freedom.
Things can only get better in Tennessee, and considering the state is already pretty lenient, that makes it a great place to live if you like to sell or use CBD products.
