Oregon residents have a lot to be proud of when it comes to CBD legalization. State leaders have been fighting federal authorities to create new and more useful legislature, and they’ve been doing their best to ensure that Oregon residents can freely use the substance.
However, the state has had a few issues, and they’ve been buried in red tape. Some of this is due to their many different regulatory groups, and some of it is due to federal institutions.
That doesn’t mean you can’t pick up your favorite CBD-infused products, though. Despite the large amount of tension between Oregon and the federal government, you can still purchase bath products, lotions, and products such as vape juice to relieve your stress and bodily pains.
It just gets a bit confusing when you try to actually look at the laws. So, we’ve decided to break them down a bit in order to give you a better understanding of where Oregon stands on CBD.
State CBD Laws
If you didn’t figure it out from the introduction, Oregon is a pretty good state to live in if you like CBD products. The state has been supportive of CBD for quite a while, and they’ve followed in the footsteps of other states that approve of CBD.
That doesn’t mean everything is simple in Oregon. State representatives and leaders still have to fight against federal agencies to legalize a lot of different products, and they’ve caught the attention of the FDA.
In fact, Ron Wyden has had no problem calling out the FDA’s unwillingness to make changes to hemp laws. He was recently recorded while telling FDA officials that it was absolutely unacceptable that they wanted five years just to complete their own regulation guidelines.
How does all of this affect Oregon, though? Well, they seem to be under more scrutiny from the FDA than other states due to the amount of attention they’ve garnered. This means that they have to carefully follow the federal laws that prevent high-potency CBD products from being sold, and they’ve had to follow the rules about therapeutic claims.
You won’t see any CBD products claiming to cure Alzheimer’s or help with schizophrenia on Oregon shelves. You also won’t see any CBD products that have more than .3 percent THC in them. Since marijuana is legal in Oregon, it is possible for Oregon-based companies to produce those products, but regulatory agencies won’t consider them CBD products, and they can cause a lot of legal issues if they’re moved out of the state or sold to minors.
Essentially, any high-potency products will be treated the same way that marijuana is. So, CBD manufacturers tend to stay away from them. That’s nothing to worry about, though. You can just buy marijuana if you want that type of experience.
The good news is that just about anyone can buy standard CBD products in Oregon, and they’re commonly found in gas stations, pharmacies, and corner stores. The only catch is that they can’t claim that the products cure, prevent, or treat any illnesses, and they cannot be labeled as a dietary supplement or food additive.
Oregon is fairly relaxed about the sale of CBD products, but they do have some issues that stem from their many different regulatory agencies. CBD laws are constantly changed by three different agencies in Oregon. The Agricultural Agency, Oregon Health Authority, and Liquor Control Commission all have power over CBD regulations in the state.
This has led to a lot of medical practitioners being confused about whether or not they can suggest the products to their patients, and it has completely stopped them from selling the products. They can still use them to treat children who are affected by severe epilepsy, though. If you want CBD, you’ll have to do your own research and buy it.
Finally, it’s perfectly safe for you to travel around the state with CBD products. Oregon’s law enforcement isn’t going to fine you or arrest you. However, if you’re CBD product contains more than the federal limit of THC, you’ll have to abide by all of Oregon’s marijuana regulations. That means you can’t drive while using it, and you can’t use it if you’re under 21. You’re unlikely to have access to any products like that, though. They can’t be sold as CBD products. So, you’ll know you’re carrying a marijuana product around.
Federal CBD Laws
The federal government is at the core of most of the issues surrounding CBD. In short, they consider any product with less than .3 percent THC a regular CBD product, and states have to regulate anything that exceeds that based on their own marijuana laws. They also put the FDA in charge of setting guidelines that every state must abide by.
That’s where the issues start to pour in. The FDA has a lengthy and very expensive approval process for anything that claims to have medicinal or food uses. That has prevented the sale of CBD food products in most places, and it even led to more than 3,000 pounds of CBD-infused chocolates being confiscated in Nevada.
Those products have been sitting in a government-owned freezer while the FDA continues to keep a firm grip on their current CBD laws, and that’s just one example out of hundreds.
Some state-level authorities such as Oregon’s senator have pressured the FDA to move the process along, and they want CBD to be included on the list of safe food additives.
The FDA has chosen to fight against that pressure by claiming that there are too many CBD products being created at once, and they want to make sure that they’re all safe. Of course, that means that they want every company producing food products to go through their very expensive approval process.
When it comes to companies making therapeutic claims, the FDA has shown little desire to work with manufacturers.
It has also caused problems for CBD consumers that frequently travel by plane. The TSA will not allow you to carry CBD products that are not FDA-approved. As you can tell by our last section, the FDA doesn’t approve of very many products. So, plane travel can be somewhat difficult.
The murky status of CBD’s legality also makes it difficult to transport products between states. A lot of distribution companies have had issues with their truck drivers getting arrested, and normal citizens can also get in trouble while moving between states with CBD on them.
At the time of this article’s creation, the FDA is claiming that it will take more than five years for them to solve all of these issues.
How To Use It
Since CBD typically comes in the form of an oil, it’s an extremely versatile product. All manufacturers have to do is add CBD oil to anything they want, and they can create a variant that supplies all of the benefits of CBD.
Let’s go over some of the most common and most innovative ways to use CBD.
These are a bit harder to get a hold of in a legal manner. The FDA considers any CBD product that is marketed for use in food products as a dietary supplement. If you read the legal sections of this article, you know there are some issues surrounding dietary supplements and the FDA.
However, that doesn’t mean that they’re off-limits everywhere. Some states have been lenient enough to allow CBD products to be sold in small restaurants, and some craft brewers have made CBD-infused beers. Candies and other treats have also popped up on some store shelves.
We don’t think we need to tell you how to eat. So, you won’t find a tutorial here.
On the federal level, those products aren’t legal unless they’re approved by the FDA. So, you’ll want to look into your state’s laws before you decide to sell anything of that nature or carry it around, and you’ll want to get a feel for how your local government handles that sort of thing.
Hemp cigarettes are becoming one of the most popular ways for smokers to kick their habit. They don’t have all of the harmful substances in them that cigarettes do, and they aren’t addictive like nicotine is.
These are getting more popular than vape juice because they look and feel like a real cigarette, but they’re not as harmful. When you use vape products, it’s a different experience, and some people feel that they don’t satisfy their urges as well.
The problem with hemp cigarettes is that they still put smoke in your lungs, they smell similar to marijuana, and they’re more than twice the price of most cigarettes. If you’re in a state that hasn’t legalized marijuana, the similar appearance and smell might make the cops investigate what you’re smoking.
That being said, they are a lot better for you than tobacco cigarettes, and a lot of people are successfully quitting tobacco because of them.
You might have seen some new spray bottles on the counter of your local corner store. If they look similar to nasal spray and say CBD on the front, they’re CBD sprays.
These are convenient for people that don’t want to use products that take a while such as topical creams and bath bombs, and they’re great for people that don’t want to get into vaping or using hemp cigarettes.
To use these, you simply spray them into whatever the bottle says to, and you experience the effects of CBD. Some sprays are meant to be sprayed on food, and some are meant to be sprayed directly into your mouth. The oral sprays take affect a lot faster.
If your pet suffers from one of the things that CBD treats, you might want to try giving it a CBD-infused treat. It’s easier to find dog treats that are infused with CBD than it is to find human food with it. The FDA doesn’t tend to be as strict with animal products.
If you can’t find treats that are infused with CBD by the manufacturer, you can buy a spray that you spray onto their treats yourself.
As one of the states that is leading the charge against the FDA, Oregon has some pretty lenient CBD laws. You’ll still have to put up with a few federal regulations, but that’s a lot better than what other states are doing.
However, we will warn you that you should consider a few factors in your personal life before you start using CBD. It’s a common misconception that CBD doesn’t have any known side-effects. While it’s a great chemical, that’s simply untrue.
If you’re on certain medicines, CBD can increase the amount of medication in your system. With some dangerous medications, that can be a pretty big issue. You might also feel a bit of nausea or a headache. Do your own research if you’re on any medications and try to start out with small amounts of CBD until you know how you react to it.
