North Dakota has been a bit slow when it comes to embracing cannabis in any of its forms, but it has followed federal law. As of April of 2019, CBD products are now legal in North Dakota.

There are a few restrictions that they take very seriously, and you shouldn’t expect to find some of the unique CBD products that friendlier states allow, but you can still legally possess and use your standard CBD oils, muscle rubs, and sprays.

Since April, CBD has become a popular product in North Dakota, and it’s expected to keep growing in popularity.

However, a lot of North Dakota residents are still confused by the state’s laws. So, we’re going to clarify what the different laws mean and how they affect you.

State Laws

North Dakota has legalized CBD products with the North Dakota House Bill 1113. The bill had an emergency clause that legalized CBD products that met the federal government’s restrictions.

North Dakota law enforcement officers have issued an advisory to help retailers and consumers understand the law a bit better. In their advisory, the police claimed that CBD products have to abide by the federal THC limit, and they have to be made from hemp that was legally grown within the state. The latter is a requirement that helps North Dakota regulate CBD products without worrying about imported products breaking their rules.

That means that you probably don’t want to try to import your CBD products. Possessing CBD that wasn’t produced with hemp that meets North Dakota’s standards will result in you being charged with a crime.

They also take the THC limit very seriously. North Dakota has not legalized recreational marijuana, and the only way to use products that contain usable amounts of THC is to get a prescription from a doctor. For that, you need to be diagnosed with a serious illness.

If you are caught with a CBD product that exceeds the federal THC limit, you’ll be charged according to the state’s marijuana laws.

The typical laws pertaining to therapeutic claims and food products also apply in North Dakota. None of North Dakota’s CBD manufacturers can legally make therapeutic claims, and there are very few food products available. The only one we were able to find was a specific brand of CBD gummy bears. Now, you won’t find CBD cafes or bars mixing CBD cocktails in North Dakota.

North Dakota also seems to have very little interest in adjusting its CBD laws. However, there is a campaign to legalize recreational marijuana in the state, and while it has failed multiple times, it’s expected to succeed within the next couple of years. Once recreational marijuana is legalized, North Dakota might start paying more attention to its CBD laws.

The good news is that you don’t have to meet any age requirements to purchase CBD products. The state considers it suitable for people of all ages.

The counties of North Dakota have also been consistent with the way they handle CBD. While states like Texas seem to have different laws depending on which county you’re in, North Dakota has maintained a sense of order among its counties. You won’t purchase a CBD product in one county, and then have it seized by police in another. You’re safe to travel around the entire state with your favorite CBD products.

Even though law enforcement is consistent, you shouldn’t expect them to be very accepting of your CBD use. They insist on reiterating that there is no proof that the products work, and they’ve mostly treated CBD as a placebo.

It is true that there have not been enough studies to support some of the more extreme claims about CBD, but the warnings come off to discourage you from using it.

Federal Laws

The federal laws affecting CBD are what a lot of the issues surrounding the products stem from. They’re simply not fleshed out enough, and they don’t give states enough power over their regulations.

Most of the power has been handed to the FDA, and the FDA has used their power to ensure that manufacturers can’t receive an FDA approval without paying large amounts of money and time on their approval process.

That has prevented most CBD manufacturers from gaining approval for any of their products. We must remember that the small companies that dominate the CBD industry can’t afford to spend thousands of dollars and several years trying to get the FDA to approve of their products.

That lack of approval makes it hard for you to take CBD products on planes due to the TSA’s rules, and it makes it nearly impossible for manufacturers to tell customers what the products are actually used for. How can a manufacturer market their CBD effectively if they can’t tell customers about the different ailments it can treat? Could you imagine buying Tylenol without it having any of its uses printed on its label? That can scare away customers that haven’t researched the effects of CBD for themselves.

Getting CBD into the hands of the public without making therapeutic claims can be done relatively easily due to the amount of sites like this one, and plenty of CBD users have boasted about its effectiveness to help spread the word themselves, but food retailers have a different obstacle to overcome due to federal laws and the FDA.

Technically, food products with CBD in them can’t be sold without FDA approval. However, some states have blatantly ignored that due to how difficult it is to understand what the federal government wants. States like Missouri have allowed bars to blend CBD cocktails, and other states have no problem with cafes creating CBD desserts. Other states have pretty much outlawed the production of CBD food products in an effort to stay out of trouble, though.

With the laws varying from state to state, it can be very difficult to travel around the country with CBD. Truck drivers from CBD-friendly states have been arrested, and thousands of dollars’ worth of their products have been seized by police. Retailers have also been affected in ways that can destroy them financially. The only way to stop that from happening is to make the federal government adjust federal laws to keep every state on the same page.

How To Use It

If you’re looking to use CBD products in North Dakota, you won’t have as many options as the residents of Oregon or Missouri, but you can still enjoy a pretty varied selection of products. Here are a few that stand out.

Lotions

CBD lotions are some of the leading CBD products on the market. They’re easy to use, and they have a long list of benefits.

You can use CBD lotions to help fight the aging process, acne, and even some more serious skin problems that usually require medicated lotions. A lot of beauty manufacturers have been targeting women to give them an alternative to traditional anti-aging creams.

They’re also great for minor pains. CBD lotions won’t mend torn ligaments or other serious issues, but they can help you get relief from minor injuries or chronic pains. These products have grown to be fairly popular among athletes and people who are starting to feel the aches and pains that come with age.

If you want to try a CBD lotion out, you can expect it to cost a little bit more than your standard body lotion, but it’s used the same way as any other lotion. You just rub a small amount into your skin. If you’re trying to relieve your pain, try to concentrate on getting it on the affected area.

Do not use these lotions on anything that requires a doctor’s attention. If you got a little bruised up during a football game, or if you frequently suffer from knee pain due to your age, these are perfect for you. If you have any reason to believe you’ve torn a muscle or broken a bone, you need to get that checked out by a doctor. CBD isn’t a miracle drug.

Tobacco Alternatives

There are a couple CBD products that are designed to be alternatives to common tobacco products.

First, there is CBD vape juice. CBD vape juice is the most affordable alternative for smokers, and it tends to last longer. CBD vape juice works the same way as any other vape juice, and you should have no problem figuring out how to use it. Vape juice also benefits from not smelling similar to marijuana when it’s used. Hemp cigarettes do tend to smell a little bit like marijuana.

Hemp cigarettes are another alternative, but we don’t suggest smoking them unless you’re already a smoker. There’s no point in starting to smoke a tobacco alternative if you don’t already smoke tobacco. However, smokers or former smokers can enjoy these. Smoking them feels like a real cigarette, but they taste slightly different, and they smell different than tobacco. They also tend to cost quite a bit in most places. These are a great way to help yourself stop smoking, but you should be aware that they smell somewhat similar to marijuana. They don’t smell exactly like it, and any stoner will be able to tell the difference immediately, but it is similar enough that police can get confused.

Finally, you can buy CannaDip. CannaDip is almost identical to dip-style chewing tobacco, but it’s made from hemp. It tastes different than normal dip, but it feels the same, and you can get it in similar flavors. You have to make sure you buy the CBD version of it, though. Unless you’re in a state that allows you to use recreational marijuana, the THC variant can get you in quite a bit of trouble.

Pet Spray

If you have a dog or cat that is suffering from some sort of serious illness or anxiety, you can purchase a CBD spray that is specifically made to help dogs and cats. The spray is pretty easy to use, too.

You have to read the instructions to know exactly how much the manufacturer suggests for your pet’s weight, but you just spray the recommended amount onto your pet’s food before they eat. Within a few minutes, they should feel relief from whatever is causing them problems.

Final Thoughts

North Dakota isn’t the best state for CBD users, but it’s definitely better than Texas or Nebraska. Their laws are expected to get a bit better once recreational marijuana is legalized, but that is probably going to take a few years.

If you’re currently living in North Dakota, feel free to purchase anything available on your local store’s shelves. Just don’t try to import products or sell anything too innovative.

You should also try to do your own research when it comes to brands and specific products. Some manufacturers have put incorrect labels on their products, and until regulations are fully fleshed out, you can end up buying some low-quality products for the same price as high-quality products.
